This morning I woke up to an email in my inbox about Siddha Group regarding an upcoming residential project. I wondered how did it not go to the spam instead of my inbox. So, still sleepy I checked some other messages, turns out I had subscribed to some real estate forum in my litigation days, for a client.
What had happened was that I had a client come to me through a friend, asking me how to get out of a real estate project in Bangalore. They had made the down payment and signed some one page form agreement, which precluded them from suing the builders. The client wanted to get their money back as even after one year, no construction had taken place.
But the form-agreement clearly stated that the clients had to wait for 18 months before they can claim the down-payment. It was clear that if construction was nowhere by the end of one year, the handover would be delayed too. The client had lost faith and wanted an out. So they’d come to me.
I had no experience in real estate laws. So I did what any budding, desperate lawyer does: I sought help online. I googled and came across various forums which were quite helpful in terms of advice and guidance for a fellow lawyer. This is when I had subscribed to the website.
This incident refreshed my memory as to why I did not venture into real estate laws, even if it was extremely lucrative. It is because the laws are quite complex and the due diligence, title search, registration, stamp duty, zoning laws, etc. gets quite cumbersome. It was good money, but you need experience and specialised knowledge to make a career in it. The experience takes time and practice.
But the problem which remains is where to get the specialised knowledge? Where do you go for registration and stamp duties? Where do you learn how to circumvent the zoning laws and bye-laws? How to advice your NRI clientele regarding acquisition of property in India?
